From Wikipedia, the free encyclopedia
Arguido (male, Portuguese pronunciation: [ɐɾˈɡwidu]) or arguida (female, [ɐɾˈɡwidɐ]), normally translated "named suspect" or "formal suspect",[1] is a status in Portuguese language legal systems, including the legal systems of Portugal and Mozambique.[2] It is given to a person whom the authorities suspect may have committed an offence.[1] This designation does not exist in certain other jurisdictions.[3] In a criminal investigation a person has to be declared an arguido prior to being arrested.[4] Portuguese law makes a distinction between arguido and suspect.[5]

The rights of an arguido

If a person becomes an arguido, he automatically gains certain rights that a witness or suspect would not have.[6] An arguido has the right to be accompanied by a lawyer when questioned.[4] The investigating police may ask the arguido more direct accusatory questions (the answers to which would not be admissible in court if possibly self-incriminatory and asked of a non-arguido) but the arguido must be presented with whatever evidence is held against him or her,[6] and unlike a witness has the right to remain silent,[7] not to answer any question that may incriminate the person, and does not face legal action for lying.[8]
Witnesses in criminal investigations are legally bound to co-operate with the police and do not have the right to silence and face legal actions if they lie.[6][8] Because of the legal advantages, some individuals apply for arguido status to be given to themselves, e.g. when it would appear that the police suspect them but are trying to use their witness status to extract as much information as possible.[6]
A person who has arguido status has not been formally accused of a crime, arrested or charged,[9] and not all arguidos are subsequently charged.[1] The police may ask a court to restrict an arguido's movement and oblige him to not leave the country.[1] Arguidos cannot change their place of residence, without permission from a court.[9] There is no time limit on the status.[10]

I was talking about your repetition of Kates fears for her daughter, that she mentioned in her book... That you like to re type as often as you can get away with....

HAHA REALLY CAN i GET AWAY WITH IT 100000 TIMES? same as kate they arent the parents of a missing child they are the parents of a dead child a child who is dead because of them

Hi Fern i am not sure D.P. does fit into the reason why Madeleine is missing now like i said what i thought happened but i do believe Gerry and D.P. were abusing their kids or are.

My opinion. and that was reason for cover up.

And here is a prime example of who you should be addressing your posts to Arthur Monford, not the genuine posters on here who want the truth for Madeleine and are not only here to protect her parents at all costs even if it is for covering up a death of a little 3 year old.

They are the posters you should be concerned about.

excuse me~but why would i be concerned about a couple of male posters that revel in paedophilia~i think not!!!

Virgo who do you mean ? Pick two !

I hold further information about the conversations amongst Edward Smethurst’s Facebook friends which I have withheld from publishing. It is of a graphic nature. Given (a) Mr Smethurst’s place in society, to which you refer in your first letter, (b) the fact that he has been made aware of his Facebook friends’ interests and conversations and (c) that he may well have limited information on the conversations and interests of his friends, he may wish to be seen to be doing the right thing. He may wish to report these matters to the relevant authorities. Clearly for example be stiality is a criminal offence, and if the police are not already investigating the members of the ‘Be stiality’ Facebook group to which Ben Murphy belongs or belonged, then they probably ought to be. I would be happy to supply any information that I do have, confidentially, to your client.
